Lake v. Hobbs, et al. – CV2022-095403

Because of the importance of this Civil Action contesting the results of the November gubernatorial election — as well as the uniqueness of it and its high-profile status in the eyes of the public — I am posting a link below to the Clerk of the Superior Court webpage on Maricopa County’s website where all of the documents being filed under this lawsuit are being posted. The suit (“complaint”) was filed by Kari Lake against Secretary of State/Governor-elect Katie Hobbs, the Maricopa County Board of Supervisors and its five individual members, Maricopa County Recorder Stephen Richer and Maricopa County Elections Co-Director Scott Jarrett.

The suit was filed late Friday afternoon, December 9, 2022. The week following the filing saw a flurry of activity, as members of the Board of Supervisors were ordered to appear along with the other defendants and plaintiff Kari Lake at a Return Hearing before Maricopa County Superior Court Judge Peter Thompson on Tuesday, December 13th, 11:00am.

As per the order, all parties including Plaintiff Kari Lake and several attorneys representing both her and the Defendants appeared virtually before Judge Thompson to set a court schedule for the trial (which Arizona law refers to as a “hearing” in an election contest).

The next day, Wednesday, December 14th, the Board of Supervisors met in executive session to discuss the matter and get advice from their legal counsel regarding the impending litigation.

As discussed during their Tuesday court appearance, the defendants’ attorneys filed two Motions to Dismiss on Thursday, December 15th, one for the Defendants and one for Secretary of State Hobbs, and a third Motion to Dismiss on behalf of Katie Hobbs in her personal capacity on Friday, December 16th. The attorneys for Kari Lake filed their consolidated, unified Response to all three Motions today, Saturday, December 17th. If the defendants have any replies to make to the Lake response, they have until tomorrow, Sunday, December 18th at 5;00pm to file.

Oral arguments for the Motions to Dismiss are scheduled for Monday, December 19th before Judge Thompson, 9:00am to 11:00am. If the Motions are denied, then the trial (hearing) will proceed as scheduled on Wednesday, December 21st and Thursday, December 22nd, 9:00am to 4:30pm. Judge Thompson would then have, by law, five days, until December 27th, to issue a ruling.

Late Friday, December 16th (9:48 pm), a two-part Motion to Quash Subpoena for County Recorder Stephen Richer was filed. Both parts of the Motion state that Recorder Richer (named as one of the defendants) cannot appear either in person or virtually online for the hearings next week as he and his family will be on vacation in Panama.
