Lake’s Case against Maricopa County and Arizona Secretary of State Hobbs Moves Forward

On Monday evening, December 19th, Judge Peter A. Thompson issued his decision on the three Motions to Dismiss Kari Lake’s Complaint in Special Action and Verified Statement of Election Contest that were filed last Thursday, December 15th and Friday, December 16th.

Oral arguments on these Motions were held yesterday.

In his decision (“UNDER ADVISEMENT RULING”), Judge Thompson dismissed eight of the the ten Counts that were set forth in Lake’s Complaint. He also denied the Motions to Dismiss that were filed against the two remaining counts. This means his decision allows the two remaining counts to be heard at trial by the Court later this week.

It means the Lake v. Hobbs, et al. trial will proceed as scheduled on Wednesday, December 21st and Thursday, December 22nd. The ballot inspection requested by Lake took place earlier today, Tuesday, December 20th, at 8:00am.

The trial (evidentiary hearing) will begin tomorrow morning at 9:00am in Maricopa County Superior Court before Judge Thompson.
